SoberTracker Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and SoberTracker ("we", "us") governing your use of the SoberTracker iOS app and related support services (the "Services"). By using the Services, you agree to these Terms.

2. The Services

SoberTracker offers sobriety tracking, streaks, check-ins, milestones, goals, reminders, journaling, trigger logs, insights, and optional premium features. We may add, change, or remove features at any time.

3. Health and Emergency Disclaimer

The Services do not provide medical advice, diagnosis, treatment, detoxification supervision, counseling, or emergency services. The Services are not a substitute for care from qualified medical or mental health professionals. If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.

4. Eligibility

You must be at least 13 years old to use the Services. If you are a minor, you may use the Services only with the consent of a parent or legal guardian. The Services are not available where prohibited by law.

5. Your Data and Device

Your recovery entries are stored locally on your device and are not uploaded to our servers. You own your content and are responsible for the security of your device. Deleting the app may permanently remove your data.

6. Acceptable Use

  • Do not use the Services for any unlawful purpose.
  • Do not attempt to gain unauthorized access to the Services or related systems.
  • Do not reverse engineer, decompile, or disassemble the app except where permitted by law.
  • Do not resell or commercially exploit the Services.
  • Do not interfere with the Services using automated means or introduce malware.

7. Purchases and Subscriptions

Paid features are billed through the Apple App Store. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID settings. Refunds are handled by Apple under its policies. RevenueCat is used to verify purchases and manage entitlements.

8. Intellectual Property

We own all content, software, and design in the Services. We grant you a limited, personal, non-transferable, non-commercial license to use the app.

9. Third-Party Services

The Services depend on third parties, including Apple, Firebase, and RevenueCat. We are not responsible for the actions, availability, or policies of third-party services.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, or uninterrupted operation. We make no guarantees regarding sobriety or recovery outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the greater of $100 USD or the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to defend and indemnify us against claims arising from your unlawful use of the Services or violation of these Terms.

13. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access for material violations of these Terms or if we discontinue the Services.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware. The state and federal courts located in Delaware have exclusive jurisdiction over disputes arising from these Terms.

15. Changes to Terms

We may update these Terms from time to time with notice, such as by posting the updated Terms on this page. Continued use of the Services after changes take effect constitutes acceptance.

16. General Terms

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services. You may not assign these Terms without our consent.
